It’s time for the weed report!

Arm yourself with knowledge: Attorney General Jeff Sessions suspends the Cole Memo.  This is a big deal!  The Cole Memo provides basic and sensible rules for cannabis companies to follow as a guide to stay as righteous as possible and includes the following priorities:

  • Preventing the distribution of marijuana to minors;
  • Preventing revenue from the sale of marijuana from going to criminal enterprises, gangs and cartels;
  • Preventing the diversion of marijuana from states where it is legal under state law in some form to other states;
  • Preventing state-authorized marijuana activity from being used as a cover or pretext for the trafficking of other illegal drugs or other illegal activity;
  • Preventing violence and the use of firearms in the cultivation and distribution of marijuana;
  • Preventing drugged driving and the exacerbation of other adverse public health consequences associated with marijuana use;
  • Preventing the growing of marijuana on public lands and the attendant public safety and environmental dangers posed by marijuana production on public lands; and
  • Preventing marijuana possession or use on federal property.

Suspension of the Cole Memo will allow US attorneys to use federal funds as they see fit to prosecute cannabis activity.  We are so fortunate to be in a state where our Governor and Attorney General are very strong advocates for legalization.  It is also worth mentioning that our entire I-502 system was written in such a way that should the Feds compel our state to act, lawmakers can remove the mention of cannabis from all RCW, rendering it locally unenforceable, preventing the Feds from forcing local authorities to do their bidding.  We are a long way from that but at least we know we have an escape route.

Personally I am not worried about this yet.  The public is very strongly in support of legalization and our I-502 system is robust.  I feel like this is an issue that galvanizes a wide array people in a unique way, bringing together all political stripes who happen to believe adults should be able to do whatever they like with their own bodies, especially if it’s part of a well regulated state system of a non-lethal intoxicant that generates tons of taxes and has been declared reasonably safe through high standards and quality control.
